This article discusses two incidents in detail. The first is the ruling by the B.C. Court of Appeal on the test case challenging the immigration laws. The court delivered a lengthy judgement, upholding the right of the immigration board to make decision based on orders-in-council, and referencing the British North America Act as granting dominions the right to exclude any aliens regardless of British citizenship. The second is the continuation of an incident where five passengers of the Komagata Maru were permitted by immigration authorities to disembark to discuss a matter with a group of friends from Nanaimo and were then prevented by the other passengers from re-embarking. The Japanese consul has now become involved, issuing an ultimatum to the passengers that the five must be allowed to re-embark. |
