ly in front. of them travelling in
the same direction.

left to avoid an over-taking col-
lision with the green auto when,

lision with the bus continued for
some 75 feet, more or less on
the shoulder of the road, until
it overturned. The right door of
the coach model swung open and
Mrs. Dospital was thrown out,
Mr. Dospital said, and the car
continued to turn over until it
landed upright again about 100
feet from the point of impact
with the bus and crosswise on
the half of the pavement. It
missed a milk stand, mail box
and? highway sign*® post in its
course. Dr, H. E. Cannon testi-
fied that Mrs. Dospital was in-
stantly killed when broxen ribs

husband escaped with but a cut

An open,verdict was returned
by the jury, simply stating that
Mrs. Dospital had met her death
in an auto accident and where
and when it occurred, but adding:
“We, the jury, highly recom-
mend that the authorities take
action to curb the size of truck
loads on all highways.”

Members of the jury were:
Herb Ashdown, Charles Robin-
son, T. Akins, James Webster,
Fred Sterling and Bert Andrews.
Mrs. Dospital was buried Mon-
day at Aberdeen cemetery, Mats-
qui. Henderson Funeral Home,
Abbotsford, had charge of the
arrangements. Born in France,
on July 4, 1898, she had resided
.in Matsqui 9 years and 16 years
in B.C.

Central Fraser Valley Fair Board
held in Trinity United Church on

cake classes in the Women’s Sec-
tion, one the best wartime cake
and the other a cake made as
nearly as possible to a recipe
secured from Miss Henderson of
the Vancouver Province.

Wilde, M-S-A manual arts in-
structor, who “had suggested

TEAM DROWNING IN
MATSQUI CREEK MUD

working nearby.

The team was very thirsty
and the creek deceptive, only
a shallow flow of water pass-
ing over several feet of silt.
The horses slid down the bank
and at once were nearly sub-
merged in the silt.

Sacks were wrapped around
a horse’s neck then a light log-
ging chain was hooked around
the neck and the end connect-
ed to a cable attached to the
bulldozer. In this way each
horse was then drawn out of
the mire. Within a moment or
two of rescue they were on
their feet again, apparently
none the worse for their ex-
perience.

Seven Teachers Busy
With Enrolment of 70

With an enrolment of about 70
pupils, the Vacation Bible School
held at the Pentecostal Taber-
nacle, concludes its third and
final week this Friday. The
closing exercises will be held on
Friday evening when the stu-
dents will give a display of work
completed during the past three
weeks, A special program, to
which the public is invited, has
been prepared.

The age groups have ranged
from three to fourteen years. Un-
der the direction of Mrs. J. Peel,
one of the major studies has
been singing and the study of a
percussion band. In the manual
arts class, the boys have made
orange box chairs, tie racks and
other useful articles. Among
other things, the girls have made
many sewing articles. The staff
has included seven teachers gad

one-half lots and the pioneer
one-story building to which was
added a small addition to house
equipment of the Volunteer Fire
Brigade and the ARP pumper. A
meeting place for numerous or-
genizations when operated by the
Men’s Club and latterly by the
village, the old ‘structure was
erected between 30 and 40 years
ago as a creamery. In _ recent
years it has been headquarters
for the M-S-A Area ARP or-
ganization.

A new firehall with concrete
floor, frame construction and im-
mitation brick exterior finish ‘is
under construction on Montrose
avenue, half a block north Of Es-
sendene avenue.

ECLIPSE SEEN CLEARLY

Eclipse of the sun by the moon
was seen clearly here early Mon-
day morning as the sun rose
over the mountains north of
Cheam Peak. Observed with sun
glasses the solar phenomenon

watchers said, at 5:47 a.m. and
then the eclipse lessened and was

FINED $10, COSTS

Charged with dumping abnox-
ious material on the side of a
highway, Joseph Olund, Mission
appeared in Matsqui police court
Tuesday morning and was fined
$10 and costs. It is an offense
under the Highway Act to dump
garbage or refuse of any kind
on the roadside.

The charges against Sterling
Parberry were that between Oct-
ober 1944 and March 1945 he
had delivered gasoline to a deal-
er without securing the necessary
coupons in return and that he
had uncancelled, loose coupons in
his possession when apprehend-
ed.

Irving S. Parberry ‘was charg-
ed with delivering graded gaso-
line to consumers without ob-
taining the necessary coupons in
exchange and entering into an
arrangement, in contravention of
the regulations, with Sterling
Parberry.

Evidence was submitted by
Const. James E. Merton, RCMP,
Abbotsford, Const. A. Smith, RC-
MP, Vancouver, and by investi-
gators of the Wartime Prices
and Trade Board. W. H. Camp-
bell prosecuted for the WP &
TB and W. E. Haskins of Van-
couver was counsel for the two
defendants. Several adjourn-
ments of the hearing have oc-
curred since March.

Frank M. Elliott, legal special-
ist, Standard Oil Co. of B.C. Ltd.,
testified that, in the period
named, the company had a con-
tract with Sterling Parberry to
conduct its “Abbotsford” whole-
sale station and had sublet its
leased retail “Bakerview” station
to Irving S, Parberry.

Visited Stations, Farm

Police officers. and investiga-
tors testified to visiting the two
places on March 8 last and ex-
amining the records. They found
20 loose commercial coupons un-
cancelled and Sterling Parberry
produced 34 loose coupons from
his person of which 19 were un-

ford Lions Club,

Used Clothing Drive
President Harry Cannon an-
neunced that in the fall, in con-
junction \ with all the Lions Clubs
in Canada, Abbotsford Lions Club
would stage a-drive for used
clothing to be sent to Europe’s
hundréds of thousands of needy.
Next regular dinner meeting of
Abbotsford Lions Club will be
held early in September. During
the summer months, however,
club members will continue act-
ively pushing sales of subscrip-
tions for the Abbotsford Lions
Club’s $11,500 farm draw, aiding
the M-S-A Hospital building fund
and Abbotsford Lake recreational
park project.

Eastern air command said one
flier was killed on the lost search-
ing plane. His name has not
been released yet, Included in
the men rescued were FL Dun-
can McNab, navigator, Boundary
Bay; Fit. Sgt. James Bates, Ab-
botsford. The men spent four

Records revealed, it was stated,

that a large quantity of marked
gasoline had been supplied to a
farm account in the name of I.
S. Parberry of Huntingdon, 1164
gallons. Sterling told them this
was his father’s farm which op-
erates 2 tractors, a gasoline veh-_
icle and a gas engine.
The farm was visited by the
officials and the gas pump and
tank there did not indicate re-
cent use. They returned to the
gas stations and Sterling admit-
ted, they said, and signed a
statement to the effect that he
had not delivered the gas to the
farm but to the Bakerview tanks
and that the farm receipts for
the gas signed R. Parberry had
been signed by himself. The
statement was submitted.

Seek Dismissals
Defence counsel asked for dis-
missal of the charges on the
grounds it had not been shown
that Sterling Parberry was oper-
ator of the station as, he con-
tended, was required. The regu-
lations he said were due to the
War, were necessary but drastic
and of the type found in totali-
tarian states, infringing on the
liberty of the subjects. It was
not required that coupons in
books be marked. If the court
found against his client, he said
the casé would “undoubtedly go
to a higher court.”

In the charges against Irving
Parberry it was contended that
while the retail was’ sublet to
him it was operated by a daugh-
ter, Margaret, and supervised by
Sterling Parberry. Mr. Parberry
was unaware of what was taking
place and signed cheques in con-
nection with the business as a
matter of routine.

Explanations

After some debate between the
Court, prosecutor, counsel and
accused, the Parberrys changed
their pleas of not guilty to tech-
nical pleas of “guilty, with ex-
planation.”

It was contended on behalf of
Sterling Parberry that he was
trying to conduct both stations
and a milk tryck line and help
on the farm due to the labor
shortage. He had been ill and
returned to work to find that
ecupon books had not been ap-
plied for for the milk trucks and,
as it was essential that they
operate in the public interest, gas

had been supplied them with-
out coupohs. To straighten the
matter out he had transferred
gasoline via the farm account.
Unfortunately a lot of gasoline
had been used without follow-
the proper procedure. There

was no doubt the law had been
evaded but it was suggested a
nominal fine should be imposed
under the circumstances. The
