THE DAILY PROVINCE DECEMBER 10, 1913 HERNAN SINGH HOLDS THE FORT p.1 ------------------- Immigration Officer at His Elbow Ready to Make Arrest. ------------- Hindu Was Successful Today in “Beating” First Conviction. ------------------Justice Macdonald decided in Supreme Court today that Hernan Singh had not properly been ordered deported because only six members of the immigration board of enquiry had dealt with his case when the act required that the full board of seven should sit. Just as his lordship announced this decision, Mr. Malcolm R. J. Reid, chief immigration officer, arose and intimated that he expected to rearrest(Sic) Hernan immediately, in order that the full board could handle his case. The court asked Mr. Reid to see to it. If he had any intention of this kind, that Hernan was arrested beyond the precincts of the court. Mr. Reid agreed to this proposal at once. Hernan Singh departed, technically a free man, but got no further than the corridor downstairs, where nearly two hundred of his countrymen had gathered. After a consultation, Hernan decided to sit down for a while, and at 3 o’clock this afternoon was still seated. An immigration official is waiting nearby ready to arrest him the moment he pokes his nose out of doors. He will have to move when the janitor closes the place at 4 o’clock. At 3:30 o’clock this afternoon one of the leading Hindus informed a newspaperman that no opposition would be shown to expelling the Hindu form the building at 4 o’clock, but that the intention was that he should stay on the steps indefinitely. At the hour mentioned several of the Hindus went THE DAILY PROVINCE DECEMBER 10, 1913 p.1 for a mattress on which it is proposed that Hernan may spend the night. The Hindus are figuring that no attempt at re-arrest will be made until the Hindu is actually out of the courthouse grounds. On the other hand, janitor James McCann seemed to think that he did not want any campers on his front steps and talked of sending for the city police to remove Mr. Hindu if he persisted in making his bed there. A leader amongst the Hindus declared that they would have a highpowered auto on hand and he believed that in the mix-up of getting him out of the building his Hindu friends could work Hernan into a motor(?) and whisk him off.
